Petalogue: Terms of Service
These Terms of Service govern your use of the Petalogue website and the purchase of any products or services from us. By placing an order or using our site, you agree to these terms. If you do not agree, please do not use the site or place an order.
Petalogue is operated from Brisbane, Queensland, Australia.
1. About us
Petalogue is a Brisbane-based florist specialising in seasonal, locally sourced bouquets, subscriptions, and arrangements. You can contact us at petalogue.au@gmail.com for any questions about these terms, your order, or our products.
2. Orders
When you place an order through our website, you are making an offer to purchase the products at the prices listed. An order is only accepted once we have confirmed it by email and successfully processed payment. We reserve the right to decline or cancel any order at our discretion, including where stems are unexpectedly unavailable, where we cannot deliver to your nominated address, or where we suspect fraudulent activity. If we cancel an order you have already paid for, we will refund you in full.
You are responsible for ensuring all details provided at checkout, including recipient name, delivery address, contact phone number, and card message are accurate. Petalogue is not liable for errors caused by incorrect information you have supplied.
3. Pricing and payment
All prices are listed in Australian dollars and include GST where applicable. Delivery fees are additional and will be shown at checkout. We accept payment through the methods displayed on our website. Payment must be received in full before your order is prepared.
We reserve the right to change prices at any time, but changes will not affect orders we have already accepted.
4. Delivery
Petalogue offers next-day delivery across our Brisbane delivery zones. We do not offer same-day delivery. Orders must be placed before our daily cutoff (displayed at checkout) to be delivered the following day.
Deliveries are made between approximately 9am and 6pm on the scheduled day. We cannot guarantee delivery at a specific time. If a precise delivery time is critical, please contact us before ordering so we can advise whether we can accommodate the request.
If the recipient is not home, our driver will leave the bouquet in a safe, shaded location at the delivery address. Once a bouquet has been left at the nominated address, responsibility for the flowers passes to the recipient. Petalogue is not liable for damage, theft, or deterioration after delivery has been completed.
If we are unable to complete a delivery due to incorrect address details, restricted access, or any other reason outside our control, a redelivery fee will apply. See our Refund Policy for full details.
5. Seasonal substitutions
Our arrangements feature flowers that are in season and freshly sourced from the Brisbane Markets. The exact stems in your bouquet will vary from week to week. We always honour the colour palette, size, and overall style of the arrangement you ordered, and any substitutions will be of equal or greater value. By placing an order, you acknowledge that the bouquet you receive may differ in specific stem variety from the photograph displayed on our website.
6. Subscriptions
If you sign up for a weekly or fortnightly subscription, you authorise Petalogue to charge your nominated payment method on a recurring basis until you cancel. Subscriptions continue until cancelled by you. You may pause or cancel your subscription at any time via your account, provided the request is made at least 48 hours before your next scheduled delivery. Deliveries already in progress at the time of cancellation will be fulfilled and charged as normal.
We reserve the right to adjust subscription pricing with at least 30 days' notice by email. If you do not wish to accept a price change, you may cancel before it takes effect.
7. Refunds and returns
Our full refund policy is set out separately and forms part of these Terms of Service. In summary: orders may be cancelled for a full refund before dispatch, but once a bouquet has been arranged and dispatched for delivery, the order is final and non-refundable. Quality issues must be raised within 24 hours of delivery with photographic evidence.
8. Intellectual property
All content on the Petalogue website, including photographs, text, logos, and arrangement designs is owned by Petalogue or used under licence. You may not copy, reproduce, or use this content for commercial purposes without our written permission.
9. Use of the website
You agree to use the Petalogue website lawfully and not to interfere with its operation, attempt to gain unauthorised access, or use it to transmit harmful code. We reserve the right to suspend or terminate access to any user who breaches these terms.
We make reasonable efforts to ensure the website is accurate and available, but we do not guarantee uninterrupted access or that all information is free from errors. Product images are indicative and, as noted above, actual arrangements may vary.
10. Privacy
We collect and handle personal information in accordance with our Privacy Policy and the Australian Privacy Principles. We will only use the information you provide to fulfil your order, communicate with you about your purchase, and (with your consent) send you marketing communications. You may unsubscribe from marketing emails at any time.
11. Liability
To the maximum extent permitted by law, Petalogue's liability for any claim arising from your order is limited to the price you paid for the affected product. We are not liable for indirect or consequential losses, including missed occasions, emotional distress, or loss of goodwill.
Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law, including the consumer guarantees that apply to goods and services supplied to consumers. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.
12. Force majeure
Petalogue is not liable for any failure or delay in performing our obligations where the failure or delay is caused by circumstances beyond our reasonable control, including extreme weather, flooding, supply shortages at the flower markets, transport disruptions, public health orders, or acts of government.
13. Changes to these terms
We may update these Terms of Service from time to time. The current version will always be available on our website, and the version in effect at the time you place an order is the version that applies to that order. We encourage you to review these terms periodically.
14. Governing law
These Terms of Service are governed by the laws of Queensland, Australia. Any dispute arising from your use of the site or your order will be subject to the exclusive jurisdiction of the courts of Queensland.
